In this case, it is about the right of withdrawal in the Distance and Doorstep Sales Act (2005:59).
You are not particularly specific, but I assume you are referring to $11 points 4 and 5.
11 § The right of withdrawal does not apply to agreements regarding
1. a service that has been completed
- for payment if the consumer has explicitly consented to the service beginning and agreed that there is no right of withdrawal when the service has been completed, or
- in exchange for the consumer's personal data only,
2. a good or service whose price depends on such market fluctuations as the trader cannot control and which can occur during the withdrawal period,
3. a good made according to the consumer's instructions or otherwise has a clear personal touch,
4. a good that can quickly deteriorate or become too old,
5. a good that due to health or hygiene reasons cannot be returned if the seal is broken and the seal has been broken by the consumer.
Number 4 cannot be used in this case, as the coffee can last for several years.
Number 5 cannot be used either, as the seal remains intact.
So on what grounds do you claim that I do not have a right of withdrawal? Remember that the starting point is that I have a right of withdrawal. You must prove that I do not. And I do not see how you can, when you cannot use numbers 4 or 5.
